Terms and conditions

These general terms and conditions of sale (the “Terms”) apply to the event services of ADJM Événementiel, a sole proprietorship (entreprise individuelle) of Christophe Albouy, 129 avenue des Caillols, 13012 Marseille, SIRET 810 818 500 00011, hereinafter “the Provider”, for the benefit of any natural or legal person, hereinafter “the Client”. Signing the quote constitutes acceptance of these Terms.

Article 1 – Purpose

Event planning and coordination, music entertainment (DJs, musicians, artists), sound, lighting, stage and video, photography, video and photo booth, bar and service, decoration, equipment hire, as well as partner services coordinated by the Provider.

Article 2 – Quote and order

Each service is the subject of a free quote specifying its nature, the date, the times, the venue, the equipment and the price. The order is firm upon receipt of the signed quote (online or on paper) and of the deposit. Any subsequent change is the subject of an amendment.

Article 3 – Prices

Prices are expressed in euros, net of tax: VAT not applicable, article 293 B of the French General Tax Code. The prices published on the website are “from” prices, confirmed by quote. A booking fee of €50 (insurance, permit applications) may apply once per event. Travel is included within Marseille and charged beyond that at the mileage rate stated in the quote. Accommodation for staff, if the event requires it, is at the Client’s expense.

Volume discounts for the same event: 5% from 2 services, 10% from 4 services, 20% from 10 services.

Article 4 – Payment

  • A deposit of 30% is paid when the quote is signed; it secures the date and the teams.
  • The balance is paid no later than the day before the event by bank transfer, or on the day of the event, unless a written agreement provides for payment within 30 days for businesses and local authorities.
  • A security deposit cheque may be requested for equipment hire; it is returned after the event if the equipment is returned in good condition.
  • Accepted methods: bank transfer, credit card or Wero via the client area when offered, cash within the legal limit.

Any late payment by a business client gives rise to penalties at the legal rate in force and to the fixed recovery fee provided for by article L441-10 of the French Commercial Code.

Article 5 – Cancellation and postponement

  • If the Client cancels, the deposit is retained by the Provider.
  • Less than 10 days before the event, 80% of the amount of the quote is due; less than 48 hours before, the full amount is due.
  • A change of date is considered in good faith, subject to the availability of the teams and the venue.
  • If an artist or a technician is unable to attend, the Provider replaces them with a member of its communities with equivalent skills or, failing that, refunds the sums paid for the service concerned.

Article 6 – Client’s obligations

  • Provide the necessary information (times, address, access, on-site contacts, venue constraints) and obtain, unless otherwise stated in the quote, the permits specific to the venue.
  • Provide a working area that complies with safety and fire regulations, with a suitable power supply and access for the equipment.
  • Cover the meals and drinks of the staff present during the event, or the flat rate provided for in the quote.
  • Keep to the agreed times: any additional hour requested on site is charged at the rate stated in the quote.

Article 7 – Provider’s obligations and liability

The Provider performs the services with the required care and professional equipment. It is covered by professional liability insurance. It cannot be held liable in the event of force majeure, an administrative decision, weather conditions making the service dangerous, a lack of information or a non-compliant installation provided by the Client or the venue. In any event, its liability is limited to the amount of the service concerned. Hired equipment is in the Client’s custody for the duration of the hire.

Article 8 – Photographs and videos

Photographs and videos remain the intellectual property of their authors. The Client benefits from the rights of use specified in the quote (internal and external communications for business clients). The Provider may use images of the event for its promotion, unless the Client refuses in writing.

Article 9 – Personal data

The data collected is processed in accordance with the privacy policy.

Article 10 – Disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution is sought first; a consumer client may use a consumer mediator free of charge. Failing that, the courts of Marseille have jurisdiction, and the Marseille Commercial Court for business clients.
